Intellectual Property Law Experience
The major achievement in an IP case was obtaining a partial Summary Judgment which ordered cancellation of an incontestable trademark, based on trademark misuse. This was only the third time that a U.S. trademark had been cancelled for misuse and the first time that this action was obtained by Summary Judgment. Judgments obtained in related cases enforced through the use of contempt proceedings.
Corporate experience includes serving as the Director of the Patent Department of M&T Chemicals, Rahway, New Jersey (now known as ATOCHEM).
Responsibilities initially included:
As Director of Patents, M&T Chemical, Inc. administrative responsibilities included:
All world-wide corporate Intellectual Property operations for the M&T subsidiary of Elf Aquitaine.
Administrative control of Patent Department budget and supervision of the Patent Department staff which included Patent Counsel and Senior Patent attorney.
Supervision of the Patent/Trademark activities for ATOCHEM, Inc., a sister company in the Elf Aquitaine family of companies.
Coordination of activities of large staff of outside patent counsel in regard to current litigation and patent application preparation and prosecution. Provided cost and quality control over services of outside legal counsel.
Other responsibilities included the reorganization of operations of patent department to accommodate dramatic increased work load due to successful research activities and acquisitions.
Major Achievement:
Created a unique world-wide marketing and licensing program for a new industrial product which did not fall within the corporations' normal marketing programs. Supervised the program through a successful start-up. The program resulted in an unusually high ratio of profit to sales.
As the head of the Patent Department of the Chemical Group of Dart Industries, Paramus, New Jersey, responsibilities included:
Preparation of technology licenses, preparation and prosecution of patent applications both on the national and international levels.
As a Patent Examiner with the U. S. Patent Office, Washington, D. C. my areas of technology included electrochemistry and low temperature distillation, including the use of cryogenics in air separation.
